The present appeal challenges order dated 14 August 2018 passed by the District Judge at Baramati refusing to review the order passed in Appeal No.1 of 2008. The review was filed on the ground that the review petitioner had not instructed his advocate for consenting to the remand of the matter. 4. In the impugned order in paragraph 15, the learned Judge has referred to the decision of the Hon’ble Supreme Court in the case of State of Maharashtra vs. Ramdas Shrinivas Nayak1 and has observed that this issue should have been taken up before the same Judge who had passed the original order. I have perused the impugned order and the reasoning given therein. I do not find any infirmity or perversity in the impugned order. The learned Judge was correct in applying the decision of the Hon’ble Supreme Court in the case of Ramdas Shrinivas Nayak (supra). 6. In view thereof, the appeal is dismissed.
