HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. BAIL APPLICATION No. - 26479 of 2025 Court No. - 67 HON'BLE SANJAY KUMAR SINGH, J. (1) Heard learned counsel for the applicant, learned Additional Government Advocate for the State and learned counsel for the complainant in base case. (2) The instant bail application has been filed on behalf of the applicant with a prayer to release him on bail in Case Crime No. 529 of 2025, under Section 2/3 of U.P. Gangsters and Anti-Social Activities (Prevention) Act, 1986, police station Khurja Nagar, district Bulandshahar during the pendency of trial. (3) It is argued by learned counsel for the applicant that according to the gang chart, the applicant is said to have involved in 02 criminal cases being Case Crime No. 847 of 2024 and Case Crime No. 752 of 2021. In Case Crime No. 847 of 2024, the applicant has been granted bail by this Court vide order of even date passed in Criminal Misc. Bail Application No. 29030 of 2025 and in Case Crime No. 752 of 2021, he has been granted bail vide order dated 26.07.2021 passed by the Sessions Judge, Bulandshahr. Apart from the 02 cases shown in the gang chart, the applicant has been implicated in 06 more cases also, out of which, in 04 cases, he has been granted bail, in 01 case closure/final report has been submitted in favour of the applicant, 02 cases have been registered against the applicant when the applicant was in jail and 01 case is pending. He has falsely been implicated in the present case due to ulterior motive. It is further submitted that the applicant is not member of any gang. There is no prospect of trial of the present case being concluded in near future due to heavy dockets. The applicant is not a previous convict. The applicant is languishing in jail since 03.07.2025 and in Versus Counsel for Applicant(s) : Sunil Kumar Counsel for Opposite Party(s) : G.A., Ram Babu Singh Asif .....Applicant(s) State of U.P. .....Opposite Party(s)
case, he is enlarged on bail, he will not misuse the liberty of bail. (4) Per contra, learned Additional Government Advocate has opposed the bail prayer of the applicant by contending that the applicant is member of gang and habitual of committing crime.
In case the applicant is released on bail, he will again indulge in similar anti-social activities and will misuse the bail by extending threat and intimidation to the prosecution witnesses. (5) Having heard learned counsel for the parties and perusing the record, I find that it is not in dispute that the applicant is on bail in base cases, on the basis of which, F.I.R. under the U.P. Gangsters and Anti-Social Activities (Prevention) Act has been lodged. I also find that the husband of the complainant of base case being Case Crime No. 847 of 2024 has also long criminal history of 12 cases. A civil dispute between them is also going on. (6) Considering the overall facts and circumstances of the case, nature of accusation and severity of punishment, the bail application of the applicant is liable to be allowed. (7) Accordingly, the instant bail application is allowed. (8) Let the applicant - Asif involved in the aforesaid case be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned with the following conditions that :- i. The applicant shall not tamper with the prosecution evidence by intimidating/pressurizing the witnesses. ii. The applicant shall cooperate in the trial sincerely without seeking any adjournment. iii. The applicant shall not indulge in any criminal activity or commission of any crime after being released on bail. (9) In case of breach of any of the above conditions, it shall be a ground for cancellation of bail. Identity, status and residence proof of the applicant and sureties be verified by the court concerned before the bonds are accepted. (10) The trial Court shall make an endeavour to conclude the trial of the applicant expeditiously without granting any unnecessary adjournments to either of the parties in light of the provisions of Section 12 of U.P. Gangsters and Anti Social Activities (Prevention) Act, 1986.
