[2025:RJ-JP:8254] (2 of 3) [CRLMB-2557/2025] Kumar knew each other. As per prosecution case, a dummy candidate appeared on behalf of co-accused namely- Ashok Kumar in examination of PTI and in result, he was declared successful. It is submitted that in identical circumstances, bail has been granted to other co-accused persons by Co-ordinate bench of this Court in S.B. Criminal Misc. Bail Application No.11789/2024. It is submitted that co-accused Ashok Kumar has also been granted benefit of bail by this Court vide order dated 20.12.2024. There are no criminal antecedents against the petitioner and trial will take considerable time in its conclusion. Petitioner is in custody since 29.01.2025 and further custody of the petitioner would not serve any fruitful purpose. 3. Learned Public Prosecutor opposes the submissions made by the counsel for the petitioner. He submits that there is serious allegation against the petitioner as such type of offences are increasing. 4. I have considered the contentions. 5.
Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioner, so also considering the fact that co- accused Ashok Kumar has been granted benefit of bail by this Court; petitioner has no criminal antecedents as well as looking to the custody period, but without commenting anything on the merits/demerits of the case, I deem it proper to allow the bail application. 6. This bail application is accordingly allowed and it is directed that accused-petitioner Sunil Kumar S/o Somaram, shall be

It is made clear that the accused-petitioner shall mark his presence once in every three months in the concerned police station. 8. Concerned SHO is directed to maintain a register recording the attendance of the petitioner. In case the petitioner fails to mark his presence in the concerned police station, the concerned SHO is directed to immediately report the matter to the concerned Court in this regard. 9. If breach of any of these conditions is reported or come to the notice of the Court, the same shall alone be a reason for the trial court to cancel the bail granted to him by this Court.
