Neutral Citation No. - 2025:AHC:131536-DB Court No. - 43 Case :- CRIMINAL MISC. WRIT PETITION No. - 16203 of 2025 Petitioner :- Mohd Jawed Respondent :- State Of U.P. And 5 Others Counsel for Petitioner :- Phool Singh Yadav,Vaibhav Yadav Counsel for Respondent :- G.A. Hon'ble Siddhartha Varma,J. Hon'ble Anil Kumar-X,J.
1. Heard learned counsel for the petitioner and learned AGA for the State-respondents.
2. From the records, we find that the police had taken action against the petitioner under Section 170/126/135 of BNSS on
28.6.2025. Thereafter, it is apparent that the petitioner was released on bail. It appears that when again there was some disturbance being caused by the parties, then again on 9.7.2025 action was taken under those very sections. The petitioner has termed the action taken under those sections as harassment.
3. The petitioner has not been able to show to the Court any order of any civil court by which his possession has been recognised over the plots in question. Definitely to maintain law and order, it is always open for the police to take action under Section 170/126/135 of BNSS.
4. Under such circumstances, no interference is warranted. The writ petition is, accordingly, dismissed. Order Date :- 5.8.2025 SK Digitally signed by :- SUSHEEL KUMAR High Court of Judicature at Allahabad
