The application of the petitioner for grant of stay against the order of eviction and demolition passed by the Prescribed Authority on 25.06.2025 in a case under the U.P. Public Premises (Eviction of Unauthorized Occupants) Act, 1972 is fixed for disposal in appeal on 17.07.2025. The petitioner apprehending that respondents would dispossess the petitioner and demolish his constructions over the land in question, has preferred the present petition praying for a restraint order against the respondents during the pendency of the appeal. 2. Undoubtedly, the order of the Prescribed Authority entail serious civil consequences and if implemented, will render the appeal infructuous. 3. Therefore, we dispose of the instant petition with direction to the appellate authority to decide the stay application expeditiously, and till then the effect and operation of the order of the Prescribed Authority dated 25.06.2025 shall remain in abeyance. 4. It is clarified that the stay application pending before the appellant authority, will be decided on its own merits uninfluenced by the instant order.
