W.P.No.26427 of 2025 For Petitioner : Mr.J.Pradeep For Respondents : Mr.K.Raja Standing Counsel O R D E R By consent of both the learned counsel for the parties, the Writ Petition is taken up for final disposal, at the admission stage itself. 2. The instant writ petition has been filed with a prayer for issuing a Mandamus, directing the Respondents to disburse the 6% interest for belated payment of Provident Fund, Gratuity and Earned Leave Salary and consequently direct the Respondents to pay the unsettled benefits of Surrender Leave Salary, Old Medical leave amount, VRS amount and last 7 days salary within the stipulated time as may be fixed by this Court. 3. Heard the learned counsel for both sides and perused the materials available on record. 4. The learned counsel for the petitioner would submit that the petitioner has joined in the services of the Respondents-Transport Corporation and he voluntarily retired from service on 27.06.2023 as Senior 2/6 https://www.mhc.tn.gov.in/judis

The learned counsel for the petitioner would submit that though he retired from service during 2023, the respondents settled his terminal benefits belatedly on 16.04.2025. However, no interest has been paid for the belated payment. The learned counsel for the petitioner would submit that claiming interest for the belated payment and also for other eligible amount, he has sent a representation to the respondents on 21.04.2025 and such representation is pending with the respondents. Therefore, the present Writ Petition has been filed. 5.
At this juncture, the learned Standing Counsel appearing for the respondents would submit that they would consider the petitioner's representation according to it's own merits and in accordance with law. The learned Standing Counsel would further submit that as far as interest for the delayed payment is concerned, they will pay interest at the rate of 6% per annum for the belated payment of the eligible and admissible amount, as ordered in the similar writ petitions in W.P.Nos.40031, 33742 and 35806 of

W.P.No.26427 of 2025 without going into the merits of the writ petition, this Court deems it appropriate to direct the respondents to consider the petitioner's representation dated 21.04.2025 in as far as the other eligible claims and pass orders on it's own merits and in accordance with law. 7. In respect of interest for the belated payment of terminal benefits, the respondents are directed to pay the interest at the rate of 6% per annum, from the date of retirement till the date of actual disbursal of the terminal benefits to the petitioner, within a period of eight weeks from the date of receipt of copy of this order. 8.
