This writ petition has been filed with the following prayers:- "a) Issue a writ, order or direction in the nature of graciously be pleased to direct the respondent no. 3/Tehsildar (Judicial), Chandausi/ Assistant Collector, First Class, Chandausi, District Sambhal to decide the Restoration Application dated 12-03-2025 filed in Case No. 5547 of 2022 (Computerized No. T202213740405547) "Gaon Sabha Vs. Hari Babu" u/s. 67 the U.P. Revenue Code, 2006. b) Issue a writ, order or direction in the nature of Mandamus, directing the respondent authorities not to evict the petitioner from the house built over land, measuring an area about 150 sq. meters, situated adjacent to land in question having Gata No. 273 total measuring an area about 0.049 Hectare, situated at village Shahbazpur, Pargana and Tehsil Chandausi, District Sambhal till the disposal of the Restoration Application filed in Case No. 5547 of 2022 (Computerized No. T202213740405547) "Gaon Sabha Vs. Hari Babu." It is contended that restoration application is pending in proceedings under Section 67 of the U.P. Revenue Code, 2006 which is registered as Case No.5547 of 2022 (Computerized Case No.T202213740405547). Learned counsel for the petitioner submits that the said restoration application may be decided expeditiously. As no useful purpose would be served in keeping the matter pending, or calling for counter affidavit, the matter is being disposed of, at the admission stage, with a direction upon respondent no.3- Tehsildar (Judicial), Chandausi/ Assistant Collector, First Class, Chandausi, District- Sambhal to decide the restoration application dated 12.03.2025 pending in proceedings under Section 67 of the U.P. Revenue Code, 2006 which is registered as Case No.5547 of 2022 (Computerized Case No.T202213740405547), after hearing all the concerned parties, strictly in accordance with law expeditiously preferably within a period of one month from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
