ORAL ORDER
The petitioner – defendant is before this Court seeking the following prayer:
“a) Issue, writ of Mandamus and such other writ or
order or direction to Learned 2nd Additional Civil Judge and JMFC at Puttur, D.K District to dispose the IA No.6 in O.S. No 343/2019 produced at Annexure-E in a time bound Manner as expeditiously as possible and allow the writ petition in the interest of justice and equity.
b) Issue any other writ, order, or direction as this Hon'ble Court deems fit in the
facts and circumstances of the case in the interest of justice and equity.”
2. The petitioner is the defendant in a suit in O.S.No.343/2019. He preferred an application – I.A.No.6 under Section 151 of the CPC. Respondent – plaintiff filed objection to the application and the concerned Court reserved the application for orders on 14.10.2024. What has driven the petitioner to this Court is that, despite passage of more than 10 months, the concerned Court has not pronounced its orders on the application. In that light, I deem it appropriate to direct the concerned Court to pronounce its orders on the application

– I.A.No.6 filed by the petitioner in O.S.No.343/2019, within four weeks from the date of receipt of a copy of the order.
3. For the aforesaid reasons, the following:
ORDER a. The writ petition is allowed. b. The 2nd Additional Civil Judge and JMFC, Puttur, D.K.District, is directed to pronounce orders on the application – I.A.No.6 filed by the petitioner under Section 151 of the CPC, within an outer limit of four weeks, from the date of receipt of a copy of the order, if not earlier.
Ordered accordingly.
