Ajay Mohan Goel, Judge (Oral) Learned counsel for the petitioner informs the Court that as the original plaintiffs, who had filed the Civil Suit along- with an application under Order XXXIX, Rule 1 and 2 of the Code of Civil Procedure, subsequently allowed to withdraw the plaint, in terms of the order passed by the learned Trial Court on 07.10.2021, this petition has lost its efficacy. 1Whether reporters of the local papers may be allowed to see the judgment? 2 2025:HHC:27274 2. Having perused order dated 07.10.2021 and taking into consideration the fact that the original plaintiffs therein were allowed to withdraw Civil Suit though a proforma defendant was permitted to be transposed as a plaintiff, qua which order, there is still litigation going on and which is the subject matter of other CMPMO, this petition is closed as having become infructuous, for the reason that the orders against which the petitioner had approached this Court automatically lost their efficacy.
