The present contempt application has been filed pleading willful disobedience of the order dated 23.08.2024 passed by this Court in Writ-C No. 25305 of 2024. Pursuant to the order dated 24.07.2025, Mr. Shivendra Kumar Pandey, Assistant Registrar, Firms, Societies and Chits, Saharanpur Region, Saharanpur is present before the Court and filed affidavit, which is taken on record. Learned counsel for applicant has disputed the same and submitted that
order dated 28.04.2025 passed by opposite party no. 1 is in gross violation of
order of Writ Court. I have considered rival submissions advanced by counsels for parties and perused the records. Earlier order dated 11.03.2019 passed by opposite party no. 1 was Versus Counsel for Applicant(s) : Abhishek Shekhar Ojha, Anurag Kumar Ojha, Parmatma Nand Ojha Counsel for Opposite Party(s) :
Ketan Mudgal And 7 Others .....Applicant(s) Shivendra Kumar Sharma And 18 Others .....Opposite Party(s)
challenged before the Commissioner, Saharanpur Region, Saharanpur by filing Case No. 1331 of 2023 under Section 4(1-A) of U.P. Societies Registration Act, 1860, which was stayed vide order dated 27.06.2024. The said order was challenged before this Court by filing Writ-C No. 25305 of 2024, in which Writ Court vide order dated 23.08.2024 has stayed order dated 27.06.2024. Order of stay was extended from time to time. The effect of staying the order dated 27.06.2024 would be restoration of order dated
11.03.2019. In the order of Writ Court, there is no stay upon opposite party no. 1 to proceed with the matter and pass fresh order. Therefore, passing of
order dated 28.04.2025 is not in violation of order of Writ Court. Accordingly, contempt application is dismissed. Personal appearance of all the opposite parties are exempted.
