JUSTICE V SRISHANANDA ORAL ORDER Heard Sri Pruthviraj, for Sri G.Balakrishna Shastry, learned counsel for the petitioner. 2. Petition is filed under Section 24(1)(b) of the Code of Civil Procedure with the following prayer: “WHEREFORE, it is prayed that this Hon’ble Court be pleased to- Withdraw the case in M.C.No.30/2024 from the file of the Senior Civil Judge and JMFC, Hiriyur and transfer the same to the Principal Judge, Family Court at Bengaluru City to be tried by the Family Court at Bengaluru.” 3. Respondent/husband has filed a petition for divorce on the file of Senior Civil Judge, Hiriyuru. Petitioner/wife has sought for transfer of the said petition from Hiriyuru to Bengaluru on the ground that she cannot travel to Hiriyuru on account of her financial conditions. 4. Respondent/husband is represented by Sri S.N.Paramesh, advocate, before the Trial Court, but has not chosen to file vakalath, despite copy of the petition being served on him. - 3 - HC-KAR NC: 2025:KHC:42447 CP No. 275 of 2025 5. As such, this Court heard the learned counsel for petitioner/wife. 6. Petition relief cannot be granted on two grounds. 7. Firstly, case gets disposed of effectively before the Hiriyuru Court at an early point of time having regard to the pendency of the cases at Bengaluru. 8. Secondly, since the video conferencing facility is now available, petitioner/wife can avail the said facility effectively and, successfully participate in the proceedings at Hiriyuru Court. 9. If an application is filed by the petitioner/wife seeking permission to participate in the proceedings through video conferencing, learned Trial Judge at Hiriyuru is hereby directed to allow the said application. 10.
