This is an application under Section-5 of the Limitation Act, 1963 for condonation of delay of 319 days in filing the Appeal against the Judgment dated 22.04.2024 and Order of sentence dated 24.04.2024 2025:MLHC:388-DB passed by the Learned Special Judge (POCSO), East Khasi Hills District, Shillong in POCSO Case No. 27 of 2018, whereby the applicant/appellant has been convicted for the offence as defined U/s 6 of POCSO Act, 2012 r/w Section 506 IPC, and sentenced to undergo 10(ten) years of rigorous imprisonment accompanied with a fine. 2. We have perused the application for condonation and are satisfied that sufficient cause has been made out in explaining the delay. 3. Mr. S.A. Sheikh, learned GA for the respondent also has no objection to the condonation, as prayed. 4. Accordingly, the prayer is allowed and the delay of 319 days, is condoned.
