The petitioner has been made accused in connection with Jamua (Nowdiha) P.S. Case No. 195 of 2024, corresponding to POCSO Case No.153 of 2024, for the offence registered under Section 96 of the B.N.S and charge has been framed under Sections 96/65 of the B.N.S and Sections 4/6 of POCSO Act, pending in the court of learned Special Judge, POCSO Act at Girdih. Petitioner is alleged to have enticed away 15 years old daughter of the informant. It was submitted that the statement of the victim was recorded under Section 183 of the B.N.S.S, in which, she has stated that she had left her lawful guardianship according to her own wish and started living together as husband and wife. The victim is a girl of very tender age. Her consent for physical relationship is immaterial. In view of the aforesaid fact, I am not inclined to release the petitioner, on bail. Accordingly, the prayer for bail of the petitioner is hereby rejected. (Ambuj Nath, J.) BS/-
