And 12 Others Counsel for Petitioner :- Babhru Vahan Singh Counsel for Respondent :- C.S.C.,Sudhir Bharti Hon'ble Chandra Kumar Rai,J. 1.Heard Mr. Babhru Vahan Singh, learned Counsel for the petitioner, Mr. Nand Lal Maurya, learned Standing Counsel for the State-respondents and Mr. Sudhir Bharti, learned counsel for respondent No.3/Gaon sabha. 2.The instant writ petition has been filed for the following relief:- "(1) issue a writ order or direction in the nature of mandamus, commanding and directing the respondent No.2/Upziladhikari, Sadar, District-Maharajganj to decide the case No.1363 of 2024, Computerized Case No.D202405470001363 (Javed Ahmad and another versus Shaukat Ali and others) under Section 116 of U.P. Revenue Code, 2006, pending before him, within stipulated period of time as fixed by this Hon'ble Court." 3. Learned counsel for the petitioner submitted that suit for partition filed on behalf of petitioner is pending before respondent No.2/ Upziladhikari, Sadar, District-Maharajganj since 20.03.2020. He further placed certified copy of the order sheet of the pending proceeding, which has been annexed as Annexure No.2 to the writ petition in order to demonstrate that the case is not proceeding in accordance with the provisions contained under Rule 109 (10) of U.P Revenue Code Rules, 2016. 4. Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to respondent No.2/Upziladhikari, Sadar, District-Maharajganj to consider and decide the aforementioned suit in accordance with law expeditiously and preferably within a period of four months from the date of production of certified copy of this order after giving opportunity of hearing to the parties concerned and without granting unnecessary adjournments to either of the parties.
