Issue a writ order or direction in the nature of mandamus directing the the respondent no. 2 i.e. Sub Divisional Magistrate, Tehsil Rudrapur, District Deoria to decide the Case No. 3448 of 2024 Computerized T202405200303448 Case No. (Dayanath and other Vs. Munna and other) under section 134 of U.P. Revenue Code, 2006, within stipulated period or time as fixed by this Hon'ble Court." It is contended that the proceedings under Section 134 of U.P. Revenue Code, 2006 are pending consideration, which are registered as Case No.3448 of 2024 before respondent no.2- Sub Divisional Magistrate, Tehsil- Rudrapur, District- Deoria. The sole prayer made in the writ petition is for expeditious disposal of the said case. As no useful purpose would be served in keeping the matter pending, or calling for counter affidavit, the matter is being disposed of, at the admission stage, with a direction upon respondent no.2- Sub Divisional Magistrate, Tehsil- Rudrapur, District- Deoria to decide the Case No.3448 of 2024 filed under Section 134 of the U.P. Revenue Code, 2006, after hearing all the concerned parties, strictly in accordance with law expeditiously preferably within a period of two months from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
