Neutral Citation No. - 2025:AHC:122301 Court No. - 4 Case :- WRIT - A No. - 10334 of 2025 Petitioner :- Neetu Singh Respondent :- State of U.P. and Another Counsel for Petitioner :- Rakesh Tripathi I Counsel for Respondent :- C.S.C.,Siddharth Singhal Hon'ble Ajit Kumar,J. Heard Sri Santosh Kumar Jaiswal, learned Advocate holding brief of Sri Rakesh Tripathi I, learned counsel for the petitioner, Sri Siddharth Singhal, learned counsel representing respondent no. 2 as well as learned Standing Counsel for the State. By means of this petition filed under Article 226 of the Constitution, petitioner has questioned the results declared by the respondent Commission on 03.06.2025 in relation to the selection held in the vacancies advertised namely Combined Technical Services Exam-2016 on the ground that he was initially placed in the select list and required to appear for document verification and when the results were finally announced her name did not figure in the select list. She, therefore, pleads that some arbitrariness has been at the end of the Commission in not accepting the documents submitted by the petitioner. Per contra it is argued by learned counsel for the Commission that petitioner did not possess the required Diploma in Pharmacy as per rules and eligibility criteria in the advertisement. He has drawn the attention of the Court towards the eligibility clause of the advertisement which provides for the post of Pharmacist-cum- Compounder for a candidate to possess Diploma in the relevant field. He further submits that since petitioner has applied for the post of Pharmacist-cum-Compounder, therefore, she was necessarily required to possess Diploma in Pharmacy. Meeting the submissions, learned counsel for the petitioner has drawn the attention of the Court towards Bachelor Degree in Pharmacy which the petitioner possesses, copy whereof has been brought on record as Annexure No. 2 to the petition. Having heard learned counsel for the parties and having perused the records, in my considered view, if a candidate is required under the relevant rules to possess a particular qualification, then no qualification higher or equal qualification will be permissible unless and until the rules do provide for the same. Upon a pointed query being made, learned counsel for the petitioner could not demonstrate anything from the rules which would provide for equivalent qualification or higher qualification than the diploma in pharmacy so as to entertain her candidature. In view of the above, I do not find any force in the petition. Petition is accordingly fails and is dismissed.
