The captioned Writ Petition is filed seeking following reliefs: (a) To issue a Writ of Certiorari or such other writ or direction and to quash the impugned Order dated 08.03.2021 passed in case No.IAA-1-CR- 71/2014-15 by the Fourth Respondent, at Bengaluru vide Annexure-A; - 3 - HC-KAR NC: 2025:KHC:47619 WP No. 20489 of 2025 (b) To issue a Writ of Certiorari or such other writ or direction and to quash the impugned Order dated 20.11.2004 issued in Case No.I.D.No.28/2002 by the Hon'ble Third Additional Labour Court at Bengaluru vide Annexure-B. (c) To pass such other order or orders as this Hon'ble Court deems fit to grant in the circumstances of the case in the interest of justice and equity. 3. 3. The order dated 08.03.2021 passed in Case No.IAA- 1-CR-71/2014-15 by the Additional Labour Commissioner and Authority under Section 29 of the Industrial Disputes Act, 1947 vide Annexure-A and the order dated 20.11.2004 passed in I.D.No.28/2002 by the III Additional Labour Court, Bengaluru vide Annexure-B are called into question in this Writ Petition on several grounds as setout in the Memorandum of Writ Petition. 4. Counsel for the petitioner urged several contentions. Heard the arguments and perused the Writ papers with care. 5. Suffice it to note that the order of the Labour Commissioner is passed in 2021 and the order of the Labour - 4 - HC-KAR NC: 2025:KHC:47619 WP No. 20489 of 2025 Court is passed in 2004 and the same are questioned in this Writ Petition in 2025. There is an inordinate delay of almost 21 years in challenging the order of the Labour Court and 04 years in challenging the order of the Labour Commissioner. Hence, the Writ Petition is dismissed on the grounds of delay and laches. Since the Writ Petition is dismissed on the grounds of delay and laches, there is nothing to discuss on the merits of the case.
