With the assistance of the learned Public Prosecutor, we have examined the Petition along with the reliefs prayed therein. 2) The Petition seek quashing of the impugned notice dated 06/02/2018 in Chapter Case No.17/2018 as it is alleged that the said notice cannot be sustained as Chapter proceedings can be initiated for taking a measure of preventive action only against hardcore criminal or in case where it affect the people at large. It is a specific contention in the Petition that the Petitioner is entitled for the relief as the impugned notice being in the form of Chapter Case shown in the notice before Respondent No.2, cannot be taken cognizance of and for this purpose, reliance is placed upon the decision of 1/2 P.H. The State of Maharashtra and Ors.1 wherein the Court had held that unless allegations are supported by material, the order cannot be passed. 3) It appears that the Petitioner is not interested in prosecuting the Petition and in any case, the notice being issued in the year 2018 on account of lapse of time, we do not deem it appropriate to get into the issue as the proceedings, by this time, must have been taken to a logical conclusion.
