Heard the learned counsel on either side. 3. The learned counsel for the petitioner would submit that it would be inconvenient for the petitioner-wife to attend the proceedings before the Sub Court, Palladam, since the distance that would be required to travel by the petitioner for attending the hearings is more than 100 kms one way. 4. The learned counsel for the respondent states that the proceedings may be transferred to a Court in between Palladam and Salem, so that no serious prejudice would be caused to either of the parties, especially considering that the respondent is working in a private concern as a Technical Assistant and he cannot obtain leave on a regular basis, if the matter is transferred to the Family Court at Salem. 5. Considering that the Family Court, Salem would be most suited and the ideal Court to hear matrimonial disputes and better placed than the Sub Court at Palladam and also taking into account the inconvenience expressed by the petitioner, I am inclined to entertain the transfer application. 6. Accordingly, the Transfer Miscellaneous Petition is allowed and the proceedings in HMOP.No.110 of 2025 is hereby withdrawn from the file of the Sub Court, Palladam and transferred to the file of the Family Court, Salem. It is https://www.mhc.tn.gov.in/judis TR CMP No. 1294 of 2025 __________ Page3 of 4 however made clear that the Family Court, Salem, shall not ordinarily insist on the presence of the respondent-husband and the respondent is entitled to be represented by a counsel on all hearing dates, except on occasions where his presence is mandatory, for chief and cross examination.
