1. Heard learned counsel Mr. A. R. Bhuyan for the petitioner Shariful Islam @Sariful Islam.
2. The petitioner has filed this application under Section 483 of the BNSS,
Page No.# 2/3 2023 with prayer for bail as he is behind bars since 12.02.2025 in connection with Dispur Police Station Case No. 126/2025 under Sections 87 of the BNS.
3. Heard Mr. D. P. Goswami, learned Additional Public Prosecutor, Assam for the respondent State.
4. Case Diary is not forwarded. This case has been fixed for Case Diary since 27.02.2025 but the Case Diary has not been forwarded.
5. The allegation against the petitioner is that he has kidnapped the minor victim.
6. Learned counsel for the petitioner has submitted a certified copy of the
order passed in connection with Dispur P.S. Case No. 126/2025, wherein it is clearly reflected that statement of the victim has been recorded.
7. I have considered the length of detention. I have considered the submission that the petitioner is above 18 years of age. The petitioner has pledged to co- operate with the remaining part of investigation.
8. Considering all aspects, petition is allowed. The petitioner shall be enlarged on bail on furnishing a bail bond of Rs. 50,000/- with a suitable surety of like amount to the satisfaction of the learned CJM, Kamrup, (M) under the condition that: (i) The petitioner shall not exercise threats to the witnesses or the victim.
9. On breach of any of the bail conditions, the Jurisdictional Court/Elaka Magistrate is at liberty to immediately cancel the bail granted to the petitioner.
10. In terms of the above observation, this bail application stands disposed of.
11. Certified copy marked as ‘X’ will form a part of this record.
