This criminal petition is filed with a prayer to quash the entire proceedings in Crime No.67 of 2023 registered by Indira nagar Police Station, Bangalore arising out of PCR No. 1335 of 2023 pending on the file of IV ACMM, Bangalore registered for the offences punishable under Section 406, 419, 420, 465, 468, 471, 120B of IPC. 2. Learned counsel for the petitioner submits that the allegation against the petitioner and other accused in the private complaint are similar. This Court in Criminal Petition No. 8434 of 2023 C/w Criminal Petition No. 12261 of 2023 has quashed the impugned proceedings insofar as it relates to accused nos.1 to 5, 7 to 10 and accused nos.12 to 14. He submits that totally there are 14 accused in the impugned criminal proceedings. The order passed by this Court in - 3 - HC-KAR NC: 2025:KHC:42016 CRL.P No. 3511 of 2024 Criminal Petition No.8434 of 2023 and Criminal Petition No. 12261 of 2023 has been confirmed by the Hon'ble Supreme Court. Accordingly he prays to allow the petition. 3. Per contra, learned HCGP, who has appeared on behalf of the respondent no.1 - State has not disputed the submission made by learned counsel for the petitioner. 4. Perusal of the maternal available on record would go to show that, accused no. 1 to 5, 7 to 10 and 12 to 14 in the impugned criminal proceedings had approached this Court in Criminal No.8434 of 2023 and Criminal No.12261 of 2023 seeking for similar relief as prayed for in this petition. The complainant had already approached the Civil Court with a prayer to cancel the sale deed, alleging that he had not received the sale consideration under the alleged sale deed dated 31.08.2020 and therefore this Court had quashed the impugned proceedings as against accused Nos.1 to 5, 7 to 10 and 12 to 14 in Criminal petition No.8434 of 2023 and Criminal Petition No.12261 of 2023, by order dated 28.02.2024. As against the said order, the complainant had approached the Hon'ble Supreme Court in Special Leave to Appeal (Crl.)Nos. - 4 - HC-KAR NC: 2025:KHC:42016 CRL.P No. 3511 of 2024 6221-6222/2024 and the Hon'ble Supreme Court on 06.05.2024 has rejected the challenge made by the complainant to the orders passed by this Court in Criminal petition No.8434 of 2023 and Criminal Petition No.12261 of 2023 and accordingly has dismissed the special leave petition. Therefore, I am of the opinion that the prayer made in this petition by accused no.6 as against whom similar allegations are found in the private complaint as well as in the FIR registered subsequently has to be granted. 5. Accordingly, the criminal petition is allowed. The entire proceedings is Crime No.67 of 2023 registered by Indira nagar Police Station, Bangalore arising out of PCR No.1335 of 2023 pending on the file of IV ACMM, Bangalore registered for offences punishable under Section 406, 419, 420, 465, 468, 471, 120B stands quashed as against petitioner herein.
