1. This is second bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023 on behalf of the applicant for grant of regular bail to them. First bail application bearing MCRC No.6529 of 2024 was dismissed vide order dated 16.10.2024. 2. Applicant is in custody in connection with Crime No.530/2024 registered at Police Station Janjgir, District-Janjgir- Champa(C.G.) for the offence punishable under Sections NISHA DUBEY Digitally signed by NISHA DUBEY
2 420/34 the Indian Penal Code. 3. The prosecution story in brief, is that on 04.07.2024, Anita Paramhansh filed a written report at Janjgir Police Station stating that in 2020-2021, she took a loan at the behest of Sankranti Pradhan's husband, Har Prasad Pradhan, and gave the amount to Sankranti. Sankranti borrowed Rs. 3,00,000/- in Anita's name from acquaintances and used it, leading to harassment by those individuals. Similar transactions and fraud occurred with 27 other women in Anita's neighborhood, totaling Rs.39,58,000/-. Thereafter the offence has been registered against the applicant. 4. It has been argued by the learned counsel for the applicant that the present applicant has been falsely implicated in the crime in question. He submits that co-accused, who is a lady, has been granted bail by this Court in MCRC No.535 of 2025 vide order dated 20.1.2025. So far as the status of trial is concerned, only charges have been framed and the case is fixed for recording of prosecution evidence, but no evidence has been led by prosecution till date. Applicant is in jail since 5.7.2024, Therefore, he prays for grant of bail. 5. On the other hand, learned State counsel, opposes the bail application. 6. I have heard learned counsel for the parties and perused the
3 case diary. 7. On querry being made from the counsel for applicant that how the applicant is related with the co-accused, he submits that applicant was having some extra-marital affair with co-accused and this Court granted bail to co-accused on the ground that she is a lady. 8. Taking into consideration the facts and circumstances of the case, nature of allegation and further that the trial is under progress, the bail application of applicant- Prakash Madhukar Tighare, involved in Crime No.530 of 2024, under Section 420/34 of IPC at Police Station – Janjgir, District – Janjgir- Champa(C.G.), is rejected. 9.
However, this Court hopes and trusts that the trial Court shall make an earnest endeavour to conclude the trial within a period of six months from the date of receipt of a certified copy of this
order, if there is no legal impediment.
