This application has been filed under Section 430 of the BNSS, 2023 praying for suspension of sentence. The applicant Maminul Haque was sentenced to undergo 3 (three) years of rigorous imprisonment with fine by the learned Sessions Judge, Barpeta in Sessions Case No. 57/2023. I have considered the submissions made by the learned counsel for both sides. The prayer of the applicant is allowed. Accordingly, the sentence imposed upon the applicant Maminul Haque by the learned Sessions Judge, Barpeta in Sessions Case No. 57/2023 shall remain suspended till disposal of the connected appeal. The applicant Maminul Haque is allowed to go on bail of Rs.20,000/- with one surety of like amount to the satisfaction of the learned Sessions Judge, Barpeta in Connection with Sessions Case No. 57/2023.
