A Memorandum of Settlement under Section 89 of CPC read with Rules 24 and 25 of the Karnataka Civil Procedure (Mediation) Rules, 2005 has been received by the Court from the Mediation Centre. The parties have amicably resolved the matter before the Mediation Centre, and the terms and conditions are enumerated as under: "II. The aforesaid petition was referred to mediation for exploring the possibilities to resolve the dispute between the parties. During the course of mediation, they have resolved their dispute and have agreed to the following terms and conditions:- 1. The petitioner and the respondent are the legally wedded wife and husband, between their marriage having been solemnized on 28.10.2020 at Sri Mahadewara Kalyana Mantapa, Near Private Bus Stop Road, in front of Prasanna Murthy Petrol Bunk, T.Narasipura, as per Hindu rites and customs. 2. The petitioner and respondent have reconciled the differences and have agreed to live - 3 - HC-KAR NC: 2025:KHC:38455 CP No. 72 of 2025 together as husband and wife in the interest of their daughter. 3. The respondent/husband has agreed to take a house on rent exclusively for his family i.e., himself, wife and daughter. 4. The respondent/husband has agreed that his brothers will not interfere in the affairs of his family and that their interaction with his wife will be limited to the bare minimum. The respondent also assures the petitioner that any interaction with his mother will be only through him. 5. Both the parties agree that the interference from their family members in their marital affairs will be limited. 6. The respondent/husband is aware that the petitioner/wife has availed a loan of Rs.1,30,000/- by mortgaging her jewellery as she required the money to look after her minor child. The respondent/husband undertakes to help the petitioner repay the said amount. 7. The petitioner/wife hereby undertakes that she will be not threaten the respondent/husband with threats of self harm or suicide. - 4 - HC-KAR NC: 2025:KHC:38455 CP No. 72 of 2025 8. Both the parties undertake that they will work towards restoring their marital harmony in the interest of the child and live together peacefully as a family." 2. The parties are present before the Court duly identified by this respective counsel. The Memorandum of Settlement has been signed by the petitioner and the respondent, as well as their respective counsel. The memorandum is taken on record and shall form part of this order.
