The writ petition is filed seeking following reliefs: a) set-aside the dismissal order dated 07.03.2024 vide No.KSRTC:PD:DIS:510/2023/1721/2023- 24 issued by the 3rd respondent vide Annexure- C and to direct the respondent authority reinstate the petitioner to the post of driver cum conductor with all arrears of back wages from the date of suspension. b) Set aside the show cause notice dated 20.03.2024 vide No.SLA/115/2024 issued by the Hon'ble Industrial Tribunal vide Annexure-E. - 3 - HC-KAR NC: 2025:KHC:48995 WP No. 27447 of 2024 Suffice it to note that the petitioner is conductor in the establishment of the Corporation and he has questioned the order of dismissal by invoking the writ jurisdiction. The law is well settled that the workman cannot challenge the order of dismissal by invoking the writ jurisdiction. The corporation filed Serial application under Section 33(2)(b) of the Industrial Disputes Act and the Court directed the petitioner to appear. The notice is also called into question in this writ petition. In my view, the notice for appearance vide Annexure-E cannot be questioned in a writ petition. Hence I decline to exercise the power under Writ jurisdiction. The petitioner may approach the competent authority for redressal of the grievance, if so advised and if the law permits.
