Neutral Citation No. - 2025:AHC:125339-DB Court No. - 21 Case :- WRIT - C No. - 24488 of 2025 Petitioner :- Pramod Singh Respondent :- State Of U.P. And 6 Others Counsel for Petitioner :- Brij Kishore Pandey Counsel for Respondent :- C.S.C. Hon'ble Manoj Kumar Gupta,J. Hon'ble Ram Manohar Narayan Mishra,J. 1. The following prayer has been made in the present petition: "A. Issue a writ, order or direction in the nature of mandamus commanding the respondent police and revenue authorities to restore the possession of the petitioner over his property in dispute in Injunction Suit No. 2599 of 2024 (Pramod Singh vs. General Manager U.P. Mehrauri Pratham All World Solar Plant) situated in Village- Bihariya, Pargana and Tehsil- Bara, District- Prayagraj as it was on 04.06.2025, prior to the demarcation proceedings illegally conducted by the respondent authorities." 2. The case of the petitioner is that respondents No. 6 & 7, which are private companies, are interfering in the possession of the petitioner over certain property which belongs to the petitioner. Consequently, the petitioner has instituted Original Suit No. 2599 of 2024 against respondents No. 6 & 7. In the said suit, an ad interim exparte injunction order was granted in favour of the petitioner on 19.09.2024. 3. As the said injunction order was being violated, therefore, the petitioner filed an application 12Ga before the trial court to secure compliance of the injunction order. On the said application, the trial court passed an order dated 03.01.2025 directing S.H.O., Police Station Shankargarh, District Prayagraj to ensure compliance of its order dated 19.09.2024. According to the petitioner, the injunction order is still being violated and in garb of carrying out demarcation, the State-respondents have handed over some part of the suit property to respondent Nos. 6 & 7. 4. We observe that while passing the order dated 03.01.2025, the trial court has directed S.H.O., Police Station Shankargarh, District Prayagraj to submit compliance report before it. In case, compliance is not being made, the remedy of the petitioner lies before the trial court whose injunction order is allegedly not being complied with. Notably, the petitioner has already filed application under Order 39, Rule 2-A of C.P.C. and it is pending. 5. In exercise of writ jurisdiction, we decline to supervise implementation of an injunction order passed by trial court. 6. Accordingly, the writ petition is dismissed with liberty to the petitioner to pursue the remedies already availed or seek such other remedy as may be advised. Order Date :- 29.7.2025 Mukesh Kr.
