By way of this writ petition, the petitioner has primarily prayed for the following reliefs:-
“(i) That the impugned acts of the respondents, qua which details are given above, which amount to executive inaction, may very kindly be quashed and set aside with directions to the respondents finalize the inquiry against the petitioner immediately without any further delay and to take action against the persons, who are wrong-doers and

2025:HHC:6771 actually are in the helm of the affairs, for embezzlement of Government funds; (ii) That in view of peculiar facts and circumstances of the case, particularly as Government officials added as party-respondents by name in the writ petition, being in the helm of the affairs and inquiry is also being conducted by them only, present is a fit of the fittest cases in which matter is ordered to be handed over to the State Vigilance/CID so that truth can see the light of the day; (iii) That till the finalization of the case/inquiry, retiral benefits of the officials being superannuated during the course of inquiry, may be ordered to be withheld in the interest of law and justice.”

The Court stands informed by learned Additional Advocate General that the enquiry is complete and the Enquiry Report shall be out within 10 days. His statement is taken on record and the writ petition is disposed of by observing that the Authority will issue the Enquiry Report on or before 29.03.2025.

It is made clear that this Court has not made any observation as far as merit of the case is concerned nor the contents of the reply should be construed to have been taken into
consideration or accepted by this Court so as to prejudice the contention of the petitioner.

If needful is not done by 29th of March, 2025, the petitioner shall be at liberty to move an application for revival of the writ petition. Pending miscellaneous applications, if any, also stand
disposed of.
