The above Writ Petition is filed directing the Respondents to acquire 3500 square feet of land from old Gram Panchayat No. 79, which according to the Petitioner, was re-numbered as Gram Panchayat No. 129/1 situated at Village- Dongargaon, Taluka-Mawal, District-Pune, as per the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. In the facts of this case, it is the categorical contention of the Respondents that this land of the Petitioner was never acquired for the purposes of the Mumbai-Pune Expressway which it was constructed in the year 2003. They have also categorically stated before the Court that the possession of the Petitioner’s land is not with the acquiring body namely Respondent No. 4. 3. According to the Petitioner, the possession of his land is no longer with him but the acquiring body. The only evidence in that regard is Exhibit-C, which is a letter issued by the Gramsevak dated 30th May 2015 stating that the land of the Petitioner is purportedly acquired for the Mumbai-Pune Expressway. 4. We are afraid that this letter, with nothing more, does not carry out the case of the Petitioner any further. In the Award dated 20th January 1998, admittedly the land of the Petitioner is not mentioned. Further, the Mumbai-Pune Expressway was constructed in the year 2003. If the Petitioner’s land was in fact acquired for the said Expressway, we fail to understand as to why the Petitioner has approached before this Court after a lapse of 15 years. Considering the categorical case of the Respondents that the land of the Petitioner has never been acquired for the Mumbai-Pune Expressway, we find no merit in the above Writ Petition. It is accordingly dismissed. However, there shall be no order as to costs. 6. This order will be digitally signed by the Private Secretary/ Personal Assistant of this Court.
