ORDER This Petition has been filed challenging the order dated 09.08.2025 passed by the 5th respondent thereby rejected the request made by the petitioner to conduct re-investigation in Crime No.559 of 2026 on the file of the 5th respondent.
2. Heard the learned counsel appearing for the petitioner, the learned Government Advocate (Crl.Side) appearing for the respondents 1 to 5 and the

It is pertinent to point out that the petitioner is neither a victim nor a complainant, however, he is a permanent resident of the address given in the petition and he is very close to the prosecution case from the beginning, therefore, the petitioner submitted a representation before the 5th respondent seeking for re-investigation in Crime No.559 of 2016 registered for the offences under Sections 279, 337, 338 and 304A IPC on the ground that the accused falsely produced some other car instead of the car, which was originally involved in the accident. However, the said request was rejected by the 5th respondent for the reason that already investigation has been completed in Crime No.559 of 2010 and final report was filed and the same has been taken cognizance in C.C.No.74 of 2020 on the file of the learned Judicial Magistrate, Avinashi. After full fledged trial, the accused was convicted for offences under Sections 279, 337, 338 and 304A IPC and sentenced him. Aggrieved by the same, the accused filed appeal before the appellate court and the appeal is also pending in Crl.A.No.62 of 2024 on the file of learned Additional Sessions Court No.II, Tiruppur. While pending trial, the accused also filed a petition for transfer of his case from the file of Additional District Court No.II, Tiruppur and the appeal is pending on the file of learned Principal District Judge, Tiruppur. https://www.mhc.tn.gov.in/judis

4. It is the contention of the learned counsel for the petitioner that since it was a murder, the accused had changed the car and projected a new car to show that as if it was an accident. However, the Investigation Officer, without conducting investigation properly and without even identifying the car, which was involved in the accident, filed the final report. 5. It is to be noted that the case has been ended in conviction and as against the said order of conviction, the accused preferred an appeal and it is pending, therefore, the petitioner can very well approach the appellate court for appropriate relief in the appeal, filed by the accused.
