In pursuance of the earlier order of this Court, learned Standing Counsel has obtained instructions, which are taken on record. On the strength of said instructions, Shri Ashish Mishra, learned counsel appearing for the Allahabad High court submits that the matter has been decided ex-parte, but on an appropriate application, the matter has been recalled and the same is proceeded with. In view of the above, no useful purpose would be served by keeping this petition pending in view of the order, which the Court proposes to pass hereunder. Without entering into the controversy involved in the writ petition, the writ petition is disposed of with direction to the learned Commercial Court, Gautam Budh Nagar to decide Civil Suit No. 54 of 2021 (M/s Highway Enterprises Vs. National Highway Division Uttar Pradesh Public Work Department, Ghaziabad through it's Executive Engineer) within a period of six months from the date of production of certified copy of this order, in accordance with law provided there is no other legal impediment.\ It is made clear that no unnecessary adjournments shall be granted to either of the parties and in case any adjournment is sought on behalf of either of the parties, same shall be granted after imposing cost of Rs. 500/- per adjournment upon the party concerned with direction to deposit the same before the next date fixed.
