Heard learned counsel Mr. A.Chaudhury for the petitioner Jakir Hussain who has filed this application under Section 482 of the BNSS, 2023 praying for pre-arrest bail apprehending his arrest in connection with Badarpur P.S. Case Page No.# 2/3 No. 28/2025 under Section 318(4)/316(2)/316(5)/336(3)/340 (2) of BNS, 2023. 2. The allegation brought against the present petitioner is that he being the Junior Engineer under the Badarpur Chaitanyanagar Development Block, Mahakal Sribhumi had transferred some amount of money to the Construction Committee of MLA Development Scheme. In the FIR, it is alleged that it was done by the present petitioner without the knowledge of the BDO, Badarpur. There is also an allegation brought against the present petitioner that he has forged the signature of the BDO in the paying slip and in some cheques, that too, without any collaboration of some bank officials of Bandhan Bank. 3. There is no allegation that the petitioner has transferred public money into his bank account. 4. I have considered the submissions at the bar with circumspection. I have also scrutinized the Case Diary. It appears that the petitioner has appeared before the I.O. and has co-operated with the investigation. His statement has been recorded and he has not violated the bail condition. 5. Considering all the aspects, the interim bail granted to the petitioners on 19.02.2025 is hereby made absolute. 6.
