In the aforesaid order, the application filed by the petitioner seeking to re- open the evidence has been dismissed. Earlier, the petitioner/defendant’s side evidence was closed on 27.02.2024. The petitioner failed to examine the Inspector of Police, Kanniyambadi as witness pursuant to an application filed by the petitioner on 13.02.2024. Since the petitioner’s side evidence was closed, the petitioner had filed I.A. No.3 of 2024 to re-open the evidence and examine the Inspector of Police, Kanniyambadi. 3.As seen from the impugned order, I.A. No.3 of 2024 was filed by the petitioner only at the stage of arguments in the main suit. The suit is of the year 2020. The Trial Court has also observed in the main order that by calling the present Station House Officer to produce the concerned documents to give evidence, it will not affect the merit of the civil case. The Trial Court under the impugned order has dismissed the application filed by the petitioner on the ground that the application was filed during the arguments stage. This Court does not find any infirmity in the impugned order. Accordingly, this Civil Revision Petition is dismissed. Consequently, connected CMP is closed.
