1. Heard learned counsel Mr.N.Ahmed for the petitioner, Lotfar Rahman @ Rocky who has filed this application under Section 483 of the BNSS, 2023 with
Page No.# 2/3 prayer for bail as he is behind bars since 01.02.2025 in connection with Basistha P.S.Case No. 42/2025 under Sections 305(a)/318(4)/111(3) of the BNS. 2. Heard learned Addl.Public Prosecutor Mr. R.R.Kaushik for the respondent State, who has submitted that there are incriminating materials in the case diary along with CCTV footage. The petitioner works with a gang. 3. The allegation against the petitioner is that he is involved in fraudulent swapping of ATM cards and withdrawing money from the ATMs and siphoning off the money of innocent citizens in this manner. 4. I have scrutinized the case diary. 5. Indeed there are incriminating materials in the case diary. 6. I have considered the submission that co-accused have already been enlarged on bail. 7. I have also considered the submission that the petitioner is willing to cooperate with the remaining part of the investigation. The petitioner is a local resident and he has pledged to abide by any stringent bail conditions if imposed upon him. 8. The petitioner shall be enlarged on bail on furnishing a bail bond of Rs.50,000/- (Rupees Fifty Thousand) with a suitable surety of like amount to the satisfaction of the learned Eleka Magistrate/jurisdictional court under the conditions that:- (i) That the petitioner shall appear before the Investigating Officer on every fortnight till completion of
Page No.# 3/3 investigation, (ii) That the petitioner shall refrain from such activities with which he is alleged, (iii) That the petitioner shall not leave the jurisdiction of the Court without prior permission.
On breach of any of the bail conditions, the Eleka Magistrate/ jurisdictional Court is at liberty to immediately cancel the bail granted to the petitioner. In terms of the above observation, this Bail Application stands disposed of. Send back the Case Diary. JUDGE Comparing Assistant
