Petitioner by means of present writ petition has prayed for following relief: " a) Issue a writ in the nature of Mandamus commanding the respondents concerned not to demolish the shop of the petitioner further situtated at Kanoon Goyan, Jhinjhana Rural, District Shamli, Uttar Pradesh. b) Issue a writ in the nature of Mandamus to restore possession of the demolished premises to the petitioner forthwith, and pay adequate compensation for the consequential loss suffered by the petitioner." 3. The petitioner has already instituted a Original Suit No.125/2025 wherein she has prayed for following relief: "(अ) यह ककि बजररियये कडिकक्री हहक्मइम्तननाई प्रकतवनाददीगण किको कनषयेधधित ककियना जनायये ककि वह वनाकदयना किको कबनना किनाननूनदी प्रककयना अपननायये जबरिदस्तदी बयेदखल न किरिये। (ब) यह ककि बजररियये कडिकक्री हहक्मइम्तननाई प्रकतवनाददीगण किको कनषयेधधित ककियना जनाय ककि वह वनाकदयना किये शनाशांकतपनूणर किब्जये मम अननावश्यकि रूप सये हस्तकयेप किरिकिये सम्पधत्ति किये रिखरिखनाव यना मरिम्मत किरिनानये मम स्वयशां यना अपनये किमरचनारिदी किये मनाध्यम सये हस्तकयेप न किरिम। (स) यह ककि बजररियये कडिकक्री हहक्मइम्तननाई प्रकतवनाददीगण किको कनदरकशत ककियना जनायये ककि वह वनाकदयना दनारिना प्रयेकषत ककिरिनायये किको प्रनाप्त किरिये अथवना नगरि पशांचनायत किना अकिनाउशांट नम्बरि उपलबधि किरिनायये तनाककि वनाकदयना ककिरिनायये किक्री धिनरिनाकश बबकि मम जमना किरि पनायये। (द) यह ककि वनाद किना किक ल खचर वनाकदयना किको प्रकतयना ददीगण सये कदलवनायना जनायये। (य) यह ककि ददीगरि दनादरिसदी वनाद किये पत्र किये तथ्ययों किये आधिनारि परि जको ररिलदीफ बहकि वनाददी धखलनाफ प्रकतवनाददीगण फरिमनायदी जना सकितदी हको फरिमनायदी जनायये। " 4. Since the petitioner has already instituted an Original Suit No.125/2025 for the same cause of action, therefore, this writ petition is not maintainable as petitioner cannot pursue two remedy simultaneously. 5. Accordingly, Writ petition is dismissed with liberty to the petitioner to avail appropriate remedy before the appropriate forum with regard to the threat of demolition of the shop.
