JUSTICE E.S.INDIRESH ORAL ORDER 1. Heard learned counsel appearing for the parties. 2. The petitioner herein is assailing the Order (Annexure-A) dated 13.12.2017 and the Proceedings as per Annexure-A1, issued by the respondent No.1. 3. It is submitted by Sri. M. Krishnappa, learned counsel appearing for the petitioner that respondent No.1 - Commission has no jurisdiction to interfere with the civil rights of the petitioner and accordingly, he places reliance on the Judgment of this Court in W.P.No.46279/2013 disposed of on 09.10.2020. 4. Per contra, Sri. A.C. Manjunath, learned counsel for the respondent No.1 - Commission, sought to justify the impugned order passed at Annexure-A. 5. Having heard the learned counsel appearing for the parties and taking into consideration the declaration of law made by this Court in the aforesaid Writ Petition, I am of the view that, the respondent No.1 - Commission has no - 4 - HC-KAR NC: 2025:KHC:41724 WP No. 32250 of 2018 jurisdiction to interfere with the civil rights of the petitioner in so far as the subject matter of this petition is concerned. 6. It is also to be noted that the Section 8 of the Karnataka State Commission for Scheduled Castes and Scheduled Tribes, 2002, confers certain functions and powers on the Commission and to interfere with certain aspects as culled out in the said Section 8 of the Act. In that view of the matter, I find force in the submission made by the learned counsel for the petitioner. 7. Hence, I pass the following: ORDER (i) The Writ Petition is allowed.
