(Oral) Learned counsel for the petitioners submits that the petitioners had taken a house loan for a sum of Rs.13,60,000/- on 03.12.2019. He further submits that the petitioners had been repaying the installments regularly but later due to financial difficulty and ill health of family members, they could not repay the installments on time. He further submits that the petitioners are willing to pay the overdue amount for regularization of their account and would continue to pay the installments henceforth as per the schedule. 2. Issue notice to respondent No.5 at this stage only. 3. Mr. Lakshay Jindal, Advocate, accepts notice on behalf of respondent No.5 and upon instructions from Mr. Himanshu Singh, A.R., submits that the overdue amount as on date is Rs.1,12,025/- and in the event 1 SANDEEP KUMAR 2025.07.17 17:48 I attest to the accuracy and integrity of this order/judgment. CWP No.19253 of 2025 (O&M) of the petitioners paying the same within two days, their loan account would be regularized. 4. Learned counsel for the petitioners submits that the petitioners are not in a position to pay this amount within two days and would need some time in this regard. 5. In view of the above, we dispose of this petition with a direction that in the event of the petitioners paying a sum of Rs.1,12,025/- to respondent No.5 within a period of 15 days, their loan account would be regularized. The petitioners would continue to pay the subsequent installments as per the schedule. However, it is clarified that in the event of any default on the part of the petitioners, respondent No.5 would be at liberty to take action against the petitioners under the SARFAESI Act. 6. It is clarified that we are not expressing any opinion on the merits of the matter. This order shall have no bearing on adjudication by the competent Court/Tribunal.
