JUSTICE KAUSHIK GOSWAMI ORDER Date : 06.08.2025 Heard Mr. D. Mahanta, learned counsel for the petitioner. Also heard Ms. S. Yasmin, learned counsel appearing for the respondents. 2. By way of this writ petition under Article 226 of the Constitution of India, the petitioner, i.e., Parbati Basfor, is seeking appointment on compassionate ground. 3. The brief fact of the case is that the husband of the petitioner, i.e., Late Bijuli Basfor, while working in the Union Bank of India, Paltanbazar Branch (hereinafter referred to as the “respondent bank”), as a Grade IV employee in the post of FTHK, died in harness on 12.09.2016, leaving behind one daughter and the petitioner. Thereafter, an application was submitted immediately for appointing the petitioner on compassionate grounds, which was forwarded to the Senior Manager, P & D, NRO, Guwahati; however, since the respondent authority did not place the matter before the selection committee Page No.# 3/5 despite the lapse of several years, the petitioner again filed an application for consideration. However, since the same also bore no fruit, the present writ petition has been filed. 4. Today, when the matter has been called, Ms. S. Yasmin, learned counsel, appearing for the respondent bank, by placing the letter dated 05.08.2025, received from the respondent bank, submits that the case of the petitioner has been considered favourably by the respondent bank for appointment on compassionate grounds to the post of Housekeeper-cum-Office Assistant. She further submits that a copy of the same has also been furnished to Mr. D. Mahanta, learned counsel for the petitioner. 5. The letter dated 05.08.2025, is extracted hereunder for ready reference: - “Union Bank of India From: Employee Benefits Division, HR Dept. Central Office, Mumbai To: The Regional Head, Regional Office, Guwahati HR:EBD:F-2453:N-10600:2025 05-08-2025 Application for Compassionate Appointment by Smt Parbati Basfore w/o late Bijull Basfore, PF No 415270, Housekeeper Cum Peon, Paltan Bazar Branch, RO Guwahati. Late Bijuli Basfore, PF No. 415270, Housekeeper cum peon, Paltan Bazar Branch, RO Guwahati expired on 12-09-2016. The application dated 15-07-2024 for compassionate appointment of Smt Parbati Basfore w/o late Bijuli Basfore was forwarded to us with recommendations of the Regional Head, Regional Office Guwahati. Page No.# 4/5 In this connection, we have to inform that the matter was placed before the Competent Authority and the request of Smt Parbati Basfore w/o late Bijuli Basfore for compassionate appointment has been considered favourably by the Bank. Accordingly, Smt Parbati Basfore w/o late Bijuli Basfore to be appointed in the Bank as House Keeper-cum-office assistant in the State of Assam subject to passing the Medical Examination and completing all recruitment formalities of the Bank and verification of all relevant documents/information (Marksheets /Passing certificates/Caste certificate/KYC etc). We are enclosing letter no. एचआरर ईबबीडबी: HR: EBD: F-2453: N- 10600:2025 dated 05-08-2025 addressed to Smt Parbati Basfore w/o late Bijuli Basfore and request to deliver the same under her acknowledgement. The acknowledgement copy be sent to our department for our records. Please arrange for completion of the recruitment formalities as per the Banks' recruitment norms and in terms of Staff Circular No. 6164 dated 19.01.2015 (lastly modified and circulated vide staff circular no. 7621 dated 28.02.2022) and also ensure the following: 1. Obtain undertaking and include the clause as required vide Point no.13 of Staff Circular No. 6164 dated 19.01.2015 (lastly modified and circulated vide staff circular no. 7621 dated 28.02.2022). 2. To adjust all the dues of late Bijuli Basfore, before Smt Parbati Basfore is taken in the services of the Bank on Compassionate grounds. 3. On recruitment, Smt Parbati Basfore will be adjusted against 'SC' vacancy for Sub-staff Cadre of State of Assam in the Rosters. 4. In terms of Staff Circular No. 6164 dated 19.01.2015 (lastly modified and circulated vide staff circular no. 7621 dated 28.02.2022), 'a person appointed on compassionate ground in a particular year may be placed at the bottom of all the candidates recruited / appointed through direct recruitment, promotion, etc. in that year, irrespective of the date of joining of the candidate on compassionate ground.' Please acknowledge receipt of this letter and confirm compliance." Page No.# 5/5 6. Reading the aforesaid letter, it is apparent that the respondent bank has already taken a decision to appoint the petitioner to the post of Housekeeper-cum-Office Assistant on compassionate grounds, subject to passing the Medical Examination and completing all recruitment formalities of the Bank and verification of all relevant documents/information. 7. That being so, this court in the interest of justice, deems it appropriate to dispose of the instant writ petition by directing the respondent bank to complete the verification and all the recruitment formalities of the appointment, in terms of the letter dated 05.08.2025, within 2 (two) months from the date of receipt of the certified copy of this court’s order. 8. Ordered accordingly. 9. The writ petition accordingly, stands disposed of. 10. It is needless to clarify that this order shall not be treated as a precedent in any other judicial proceedings. 11.
