1. The present petition has been filed by the petitioner for grant of anticipatory bail in case FIR No.208 dated 28.08.2024, registered under Sections 408, 506 and 34 of IPC, 1860, at Police Station Salhawas, District Jhajjar.
2. Status report dated 21.08.2025 filed on behalf of the respondent-State is taken on record. Copy thereof, has been supplied to counsel opposite.
3. Vide order dated 14.07.2025, passed by this Court, the petitioner was granted interim bail and directed to join investigation.
4. Learned State counsel has submitted that that the petitioner has joined investigation on 18.08.2025. Learned State counsel also submitted that the vehicle in question involved in the alleged accident has not been got recovered by the petitioner. Therefore, his further custodial interrogation is NISHA 2025.09.03 10.54 I attest to the accuracy and integrity of this document

5. In the considered opinion of this Court in the given circumstances, non-recovery of alleged vehicle cannot itself be a ground to deny the benefit of pre-arrest bail to the petitioner. As such, the petition deserves to be allowed and the pre-trial incarceration of the petitioner is not required.

Keeping in view of the above mentioned facts and circumstances, without commenting on the merits of the case, the present petition is allowed and the order dated 14.07.2025, granting interim bail to the petitioner, is made absolute, subject to the conditions laid down in Section 482(2) of Bharatiya Nagrik Suraksha Sanhita (BNSS), 2023 (analogous to Section 438(2) of the Code of Criminal Procedure).
