It is the case of the petitioners that an advertisement was published in the local newspaper to fill up the five post at B.S.V. Madhaya Vidyalaya, Nibaranpur, Ranchi. It is an admitted case that six persons were appointed though the advertisement was to fill up five posts. Thus, the 6th persons have been appointed illegally. 3. From the argument of the parties, I find that the matter is still pending before the State and since an enquire is pending, the respondents have not taken any steps to approve the service of the five selected persons whose selection are legal. 4. In this case, since it has to be decided who is the 6th persons and has been illegally appointed and the respondents are already looking after the aforesaid issue, I direct the Director, Primary Education to take an appropriate decision in respect of appointment process. If it is found that the backdoor entrant can be segregated, the same must be done by the respondents, if there are no other illegality in the selection process. After segregating the backdoor entrant, the respondents will take appropriate decision in respect of the other five candidates, including confirmation of their service who have been selected pursuant to the advertisement dated 09.06.2022. 5. Since, it is claimed that petitioners are working and have been appointed in the year, 2022, I direct the respondents to conclude the entire process within a period of two months from the date of receipt of a copy of this order. 6. With the aforesaid observations, this writ petition stands disposed of. (ANANDA SEN, J.) R.S.
