1. Heard Mr. Chetan Singh Chauhan, learned counsel for the Petitioners. Also heard Mr. Hari Om Rai, learned Panel Lawyer for the State/ Respondent No.1 and Ms. Aditi Singhvi, learned counsel for Respondent No.2.
2. The petitioners have filed the instant petition with the following prayer:-
“A) That, this Hon’ble Court may kindly be pleased to call for the entire records of the case pertaining to FIR bearing No.029/2023 lodged at Police Station – Gharghoda, District – Raigarh, CG u/s 407 & 34 of IPC for kind
consideration of this Hon’ble Court, and /or; B) That, this Hon’ble Court may kindly be pleased to issue an appropriate order/direction quashing the FIR bearing No.029/2023 lodged at Police Station – Gharghoda, District – Raigarh, CG u/s 407 & 34 of IPC and such incidental proceedings/investigation emanating therefrom, and/or; C) Any other relief, which the Hon’ble Court deems fit and proper looking to the facts and circumstances of the case, may also be granted.”
3. At the very outset learned State counsel would submit that the charge-sheet in this case has already been filed.
4. In view of the submission made by learned State counsel, learned counsel for the petitioner seeks permission of the Court to withdraw the instant petition with liberty to challenge the charge-sheet before
3 / 3 the appropriate forum in accordance with law.
5. In view of the submission made by learned counsel for the petitioners, the instant petition is dismissed as withdrawn with liberty to the the petitioners to take recourse of law with respect to the charge-sheet.
