Neutral Citation No. - 2025:AHC:121617 Court No. - 5 Case :- WRIT - A No. - 10280 of 2025 Petitioner :- Raman Chaturvedi Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Aishwarya Pratap Shahi,Nipun Singh Counsel for Respondent :- C.S.C. Hon'ble Saurabh Shyam Shamshery,J. Heard Sri Nipun Singh, learned counsel for petitioner and Sri Devesh Vikram, learned counsel for respondent Nos.2 to 4. The petitioner, a Junior Engineer in the Purvanchal Vidyut Vitran Nigam Limited, was put under suspension by an order dated 10.07.2025 that he was not diligent towards his duties. Learned counsel for petitioner submits that impugned suspension order is illegal since it was not passed by his appointing authority or disciplinary authority as well as the order does not contemplates any departmental proceedings against petitioner as well as that nature of allegations are not serious that it would finally led to a major punishment as such in given set of circumstances, suspension was not warranted. Learned counsel for respondent submits that charges are serious and it may led to major penalty though he has fairly submitted that suspension order does not contemplate any departmental proceedings. The impugned order is passed by Superintendent Engineer, declaring that he was competent Officer to pass such order. I have considered the above submissions and perused the record. The challenge before this Court is a suspension order, therefore, at this stage, the Court is not going into veracity of allegations made therein. At this stage, on basis of documents available a categorical finding cannot be returned that Superintendent Engineer was not competent Officer to pass impugned suspension order. The Court takes note a factor which is in the favour of petitioner that in suspension order, departmental proceedings are not contemplated. The Court also takes note of submission of learned counsel for respondent that departmental proceedings, if so warrant, will be initiated within a few weeks. In the aforesaid circumstances, taking note of above referred facts that impugned suspension order is passed on 10.07.2025, though it does not contemplate any departmental proceedings, still this Court is of view that no case is made out for causing interference in suspension order which has recently been passed, however, it is observed that in case, no charge-sheet is submitted within two weeks, the suspension order will be deemed to be kept in abeyance. In case, charge-sheet is submitted within two weeks and departmental proceedings are not concluded within six weeks with the co-operation of the petitioner, still the suspension order shall be deemed to be kept in abeyance, subject to outcome of departmental proceedings and co-operation of petitioner. Accordingly, writ petition is disposed of with aforesaid observations and directions. Order Date :- 24.7.2025 P. Pandey Digitally signed by :- PUSHPENDRA PANDEY High Court of Judicature at Allahabad
