ORDER: This Criminal Petition, under Sect-Ions 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A1, seeking bail, in Crime No.5/2025 of VIzianagaram I Town Police Station. 2. A case has been registered against the Pet'ItiOner and Others for the offence under sections 20(b)('li)(B) r/w 8(c) of the Narcotic Drugs and psychotropic Substances Act. 3. Case of the prOSeCut®lOn, in brief, iSthatOn 07.01.2025 at6.30 am, on receipt of credible informat'lon regarding illegal possession and transportation of ganja, the s.I of police, along with Staff, reached FCI Godown, Vlzianagaram and found three Persons. On see-Ing POliCe, said three persons tried to flee away. But police apprehended them Who are Al and A2 and one CCIL. On interrogation, they d-lSCIOSed their identity particulars and police seized 1.5 kgs of ganja from them and they were arrested and got remanded tO judicial Custody. 4. Heard. Perused the record. 5. A perusal of the material aval'lable on record goes to showthatthe contraband that was allegedly seized from the possessI'On Of A1, A2 and one cclL was 1.5 kgs which is non commercial quantity. The petitioner was arrested on 07.01.2025 and since then, the petitioner was in judicial remand. Learned Assistant public Prosecutor submitted that major part of the investigation was completed and charge sheet could not be filed due to pending report from RFSL. 7.
