The instant criminal appeal was filed against the judgment and order dated 08.10.1986 passed by the First Additional Sessions Judge, Azamgarh in Sessions Trial No. 647 of 1983 whereby the appellant herein was convicted for the offence under Section 126 of the Indian Railways Act , 1890 with a sentence to under gone rigorous imprisonment for four years. As per the report received from the Chief Judicial Magistrate, Mau dated 18.07.2022, the sole appellant herein has died. In view thereof, the appeal filed by the appellant herein is abated. Thus, the instant appeal is disposed of as abated. The lower Court records be returned back to the lower Court concerned to be consigned, as nothing remains to be done in the matter.
