JUSTICE VINOD CHATTERJI KOUL-JUDGE ORDER 06.05.2025 Learned counsel for the appellant submits that the contract between appellant and respondent has been cancelled as in terms of order dated 21.05.2019, this Court directed the respondents to submit Bank Guarantee from a scheduled or nationalized bank in terms of RFP and the conditions laid down regarding utilization of space at Srinagar Airport. It was also directed that in case respondent failed to furnish the bank guarantee with regard to utilization of space at Srinagar Airport from a scheduled Nationalized Bank within two weeks, the appellant would be free to proceed ahead with the tendering process afresh strictly in accordance with the rules occupying the field. Mr. M. M. Dar, appearing counsel for the petitioner, submits that respondents have failed to furnish the bank guarantee in terms of order passed by this Court in this Appeal on 21.05.2019, and as a consequence of their failure, appellant has terminated the contract. Therefore, it is submitted that because of termination of the contract, this appeal has become infructuous. Learned counsel for the respondents also submits that because of termination of the contract, this appeal has become infructuous. In view of the submission made, having regard to the order passed in this appeal and termination of the contract as submitted by learned counsel for the appellant, this appeal, having been rendered infructuous, is dismissed.
