1. This petition has been filed by the petitioner in public interest alleging that the land in question, which is claimed to be a public way, has been encroached by the Nagar Nigam and that the same was being used for generation by the petitioner as road.
2. The indications made in the representations, essentially pertains to the personal cause of the petitioner, seeking to allege that the land in question was being used by him and now is being prevented by the Nagar Nigam.
3. For the said cause, which is personal in nature, filing of the Public Interest Litigation cannot be countenanced. Further claim that the Nagar Nigam has encroached over the land in question appears to be too far fetched to seek any interference by this Court.
4. Consequently, the petition is dismissed, leaving it open for the petitioner to take appropriate proceedings in accordance with law. Order Date :- 28.7.2025 nd/AKShukla (Kshitij Shailendra, J) (Arun Bhansali, CJ) Digitally signed by :- NISITH DEY High Court of Judicature at Allahabad
