Petitioner has challenged an order dated 27.05.2025, passed by Civil Judge (Senior Division), Dehradun in Original Suit No. 201 of 2025. By the said order, notice on petitioner’s Temporary Injunction Application was issued to the defendant, fixing 10.07.2025 for disposal of Temporary Injunction Application. 3. Learned counsel for petitioner submits that having regard to the facts and circumstances of the case, petitioner was entitled for ex-parte ad interim injunction. 4. This Court do not find any infirmity in the order passed by trial Court, which is in consonance with the provision contained in Rule 3 of Order 39 CPC. Thus, there is no scope for interference. 5. The writ petition is, however, disposed of with a request to learned trial Court to consider petitioner’s Temporary Injunction Application on the next date fixed, provided defendant is served.
