JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, petitioner has sought for the following relief:- “WHEREFORE, the Petitioner/accused No.1 humbly prays that, this Hon'ble Court be pleased to quash the FIR and complaint registered by the Cottonpet Police station against the Petitioner/Accused No.1 in Crime No. 0200/2024, for the offence Punishable U/Sec BNS 2023 Under Sec 305,331(3),62 act, in Pending on the file of learned V Addl Chief Judicial Magistrate at Bangalore City, in the interest of justice and equity.” 2. Learned counsel for the petitioner – accused No.1 and learned counsel for 2nd respondent – complainant have filed a Joint Memo duly signed by the petitioner, 2nd respondent and their respective counsel and the same is taken on record. - 3 - HC-KAR NC: 2025:KHC:25373 CRL.P No. 6126 of 2025 3. Petitioner – accused No.1, respondent No.2 and their counsel are physically present before the Court and they admit the contents of the Joint Memo, which reads as under:- “JOINT MEMO That the petitioners and the respondent respectfully submit as hereunder:- 1) That at the intervention of the elders and well wishers and family members, the petitioner and respondent have resolve their dispute amicably and reached to a settlement which is culminated in this joint memo. 2) It is submitted that on dated: 19.11.2024 the respondent no.2 gave a complaint Against the petitioner/accused No.1 and on that basis respondent no.1 [Cottonpet Police Station] have registered a case in Crime No. 200/2024, U/s 305,331(3) and 62 of BNS, 2023 against petitioner/accused No.1 and others, now the respondent no.2 and petitioner/accused No.1 are belong to same community and far related family members and the matter regarding the said crime has been settled with family members and out of the court, hence the respondent no.2 prays this Hon'ble court and have no objection to quash the FIR and compliant against petitioner/accused No.1. 3) The parties have entered into this joint-memo on their own оr coercion and after volition without any influence understanding the contents of the joint-memo. - 4 - HC-KAR NC: 2025:KHC:25373 CRL.P No. 6126 of 2025 WHEREFORE, the Respondent No.2/Complainant and Petitioner/Accused No.1 herein respectfully prays that this Hon'ble court kindly be pleased to quash and the FIR and Compliant registered by Cottonpet Police Station in the learned " V ADDITIONAL CHIEF JUDICIAL MAGISTRATE COURT" AT, BANGALORE, in Crime No. 200/2024, under Section 305, 331(3) and 62 of BNS, 2023 in the interest of justice and equity.” 4. In view of the aforesaid settlement entered into between the petitioner and 2nd respondent, I pass the following: ORDER (i) The petition is disposed of in terms of Joint Memo dated 10.07.2025. (ii) The Complaint / FIR in Crime No.200/2024 of Cottonpet Police Station registered for the offences punishable under Sections 305, 331(3) and 62 of BNS, 2023 pending on the file of the V Additional Chief Judicial Magistrate Court, Bengaluru, in relation to the petitioner are hereby quashed.
