Hon'ble Manoj Bajaj,J. Applicants have filed this application under Section 447 of B.N.S.S. seeking transfer of Complaint Case No. 1368 of 2021; titled : Suresh Babu Advocate v. Subhash and others, under Sections 406, 504, 506, 452 I.P.C., Police Station Jagdishpur, District Agra, pending before A.C.J.M.-10, Agra to the any other court of competent jurisdiction at district- Etawah. Learned counsel for the applicants submits that applicant no.1 is brother-in-law (jeth) of daughter of opposite party no.2 and the dispute between them is going on, therefore, the opposite party no.2 has falsely implicated the applicants in the subject complaint case at Agra, which is pending consideration before the A.C.J.M.- 10, Agra. According to him, the opposite party no.2 is a practicing advocate who on 25.6.2025 caused injuries to applicant no.2 and her nephew and in this regard an FIR No.0203 of 2025 has been registered against the opposite party no.2. He prays for transfer of the case to some other court of competent jurisdiction outside Agra. Upon hearing the ground raised for transfer of the case, this Court is not inclined to accept the same as a valid ground as the transfer of the case would not be a solution. The FIR against the opposite party no.2 has already been registered which is pending investigation. Dismissed.
