The petitioner has challenged his transfer order dated 10.06.2025, by which, he has been transferred from Government Ayurvedic Hospital, Lalpur, District Udham Singh Nagar to Government Ayurvedic Hospital, Mawani Dawani, District Pithoragarh. Heard. Learned counsel for the petitioner would submit that the petitioner has been transferred against the provisions of Section 17(2)(d) of the Uttarakhand Annual Transfer for Public Servants Act, 2017. He would also submit that, in fact, prior to his transfer, transfer options were also not invited; the petitioner could have given some good options. Learned counsel for the petitioner seeks permission that he may be given liberty to give a fresh representation to the respondents, with the directions to the respondents authority to decide the representation considering the points, which he may raise within a stipulated time and not to relieve him till his representation is decided. Learned counsel for the respondents would submit that the respondents would take a decision on the representation that may be filed by the petitioner within a period of one week and till then he will not be relieved. The Court takes on record the statement given by learned State counsel. The petition is disposed of with the liberty to the petitioner to make a fresh representation within a period of 24 hours to the respondents, with further direction to the respondents to decide the representation of the petitioner within a period of next one week.
