“a. That the appeal may be allowed by this Hon’ble Court. b. That this Hon’ble Court in due exercise of the powers contained in section 372 r/w. 378 of CrPC, 1973 be pleased to hear and grant special leave to the applicant in appeal from the judgment and order of acquittal u/s. 6 and 10 of the Protection of Children from Sexual Offences (POCSO) Act, 2012 and u/s. 354, 354-B, 376(2)(f), 323, 506(II) of the Indian Penal Code and u/s. 66-E of the Information Technology Act, 2000 dated 04.02.2020 passed by the Court of Special Judge under POCSO Act, 2012 at Greater Bombay in POCSO Special Case No.297 of 2014 dated 04.02.2020. c. That this Hon’ble Court be pleased to set aside the judgment dated 04.02.2020 in POCSO Special Case No.297 of 2014 and convict the accused u/s. 6 and 10 of the Protection of Children from Sexual Offences (POCSO) Act, 2012 and u/s. 354, 354-B, 376(2)(f), 323, 506(II) of the Indian Penal Code and u/s. 66-E of the Information Technology Act, 2000 by this Hon’ble Court. d. The Hon’ble Court be pleased to call for records and proceedings in the present case. e. That this Hon’ble Court considering the outbreak of the prevailing Corona Virus pandemic, condone the delay if any as the applicant was unable to get in touch with the lawyer and file the present appeal earlier. 1/2 931-APEAL-690-2022.doc Dixit

2. Mr. Prashant G. Pandey, the learned counsel for the appellant submits that he has received an e-mail from the appellant dated 9th December 2025 stating that the appellant is not interested in prosecuting this appeal any further. The said communication is taken on record.
